Julian Cohen spoke at Society of Construction Law's annual international; conference in Hong Kong.. The panel looked at common contractual problems in the construction industry and how to manage them.

 

 

An interesting discussion on various topics including:

 

  •  Whether contracts should allocate exceptional risks (such as pandemics) in a new manner given the limitations in common law of force majeure clauses and the doctrine of frustration.

 

  • Opportunities for the  Hong Kong construction and dispute resolution industries  with the announcement of the new Northern Metropolis

 

  • Cross border disputes 

 

  • Need to overcome due process paranoia in construction arbitrations to facilitate more robust procedures.

Resolution Chambers is delighted that on 31 August 2021, the Hong Kong Bar Association advanced equal access to the profession by announcing that barristers of all faiths may wear religious headwear in court.  Muslim women and Sikh men are allowed to wear hijab and turbans in court instead of wigs, and Jews can wear kippah under their wigs. The rule change makes clear that the Bar welcomes all sections of Hong Kong’s community, regardless of their faith. This initiative was driven forward by Azan Marwah and Shaphan Marwah of Resolution Chambers, and echoes our values of diversity and inclusion.
