A Bit More About Andrew ...
Andrew Lynn,
Barrister (England & Wales 2015, HK 2009), Arbitrator & Mediator
MA(Edin) MPhil(Cantab) PhD(Cantab) LLM (Lond) FCIArb TEP
Andrew is a barrister practising in Chancery and commercial litigation, with a focus on contentious trusts and equity, civil fraud, and cross-border disputes. He is a full tenant at Kings Chambers in the UK and Resolution Chambers in Hong Kong, and is also an associate member of 5 Stone Buildings, London. He holds full rights of audience in both England & Wales and Hong Kong, and practises actively in both jurisdictions.
Andrew's work centres on complex equitable and proprietary disputes: trustee and fiduciary duties, breach of trust, beneficial ownership, resulting and constructive trusts, and the court's supervisory jurisdiction over trusts. He also brings substantial experience in civil fraud and restitutionary claims. His particular interest is in matters turning on difficult points of trust law and equity, and he welcomes instructions in trials and appeals of that kind.
Much of his practice has a cross-border dimension, particularly in matters involving Hong Kong, where he has appeared as counsel at all levels, including the Court of Appeal and Court of Final Appeal. He was sole counsel at trial and lead counsel for the successful appellant through both appellate courts in Kan Lai Kwan v Poon Lok To Otto (2014) 17 HKCFAR 414, the leading Hong Kong authority on trust interests in divorce. In 2025, he acted as lead counsel in a three-counsel team in a 25-day civil fraud trial in the Hong Kong High Court. He has been instructed for the plaintiff beneficiary in the Lo Family Trust litigation since 2018. He appeared for the successful appellant in Lo Kai Shui v HSBC International Trustee Ltd [2023] HKCA 983, a significant Court of Appeal authority on privity, res judicata and Henderson abuse in discretionary trusts. He accepts instructions in Hong Kong in substantial matters, holds permanent residency, and travels for hearings and trials.
Andrew read English Literature at Edinburgh (First Class Honours) and Renaissance Literature at Cambridge (MPhil, PhD, St John's Benefactors' Scholarship), before converting to law (GDL, Distinction) and training as a barrister. He holds an LLM from the University of London. His published work includes articles in the Law Quarterly Review and Trusts & Trustees — including a 2022 LQR piece on constructive trusts and work in Trusts & Trustees on trusts in commercial and traditional contexts — as well as practice notes for LexisNexis Hong Kong. He is also qualified as a solicitor of England & Wales. He is a full member of STEP (TEP) and a Fellow of the Chartered Institute of Arbitrators (FCIArb).
